USE OF THE PLATFORM
Welcome to hectare.in (“Website”). Its tools and applications are an online service operated and managed by Sickle Innovations Private Limited (“Hectare”, “we”, “us” or “our”). The Website, tools and applications are together referred to as the “Platforms”.
While using Hectare’s Platforms, services or products, you are deemed to have accepted the terms and conditions of this agreement, as may be revised from time to time (“User Agreement” / “Terms of Use” / “T&C”). This agreement is valid for an indefinite period, and you understand and agree that you shall be bound by these terms for as long as you access or use the Platforms.
You may access the Platforms through a computer, mobile phone, or other devices (including iOS or Android). These Terms of Use govern your use of the Platforms regardless of the mode of access. We reserve the right to change, modify, add or remove portions of these T&C at any time without prior notice. It is your responsibility to review them periodically. Continued use of the Platforms following any changes shall constitute your acceptance of such changes.
“User” shall mean any person who browses, accesses, registers, orders products, or avails services on the Platforms.
ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORMS INDICATES YOUR UNCONDITIONAL AGREEMENT TO ALL TERMS AND CONDITIONS CONTAINED HEREIN. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.
ELIGIBILITY TO USE
Use of the Platforms is available only to persons who can form legally binding contracts under applicable law. Persons who are incompetent to contract under the Indian Contract Act, 1872, including undischarged insolvents, are not eligible to use the Platforms.
We reserve the right to terminate or suspend access to the Platforms at our sole discretion. The Platforms shall not be available to users whose accounts have been suspended or terminated for any reason.
If you are registering on behalf of a business entity, you represent that you have the authority to bind such entity to this User Agreement.
ACCURACY OF CONTENT AND INVITATION TO OFFER
We take reasonable care to ensure accuracy of product descriptions, pricing, and other content on the Platforms. Prices are inclusive of applicable taxes unless stated otherwise. Product packaging may vary from images shown. Weights, dimensions, and capacities are approximate.
While we strive to display accurate colors, actual product colors may vary depending on your device display. We are responsible only for content provided by us on the Platforms and shall not be liable for information on third-party platforms unless expressly confirmed by us.
All products and services displayed on the Platforms constitute an invitation to offer. Your order constitutes an offer subject to acceptance by Hectare. Acceptance occurs only upon dispatch of the product(s). Dispatch may occur in parts, and acceptance shall apply only to dispatched items.
GENERAL TERMS OF USE
- Users may use the Platforms only for lawful purposes.
- Prices and availability are subject to change without notice.
- Promotional offers are valid for limited periods and stock.
- Hectare may modify or withdraw offers at its discretion.
- Bank cashback offers are governed by the respective bank’s terms.
- Hectare may revise product pricing at any time.
- Hectare reserves the right to cancel orders due to unavailability, pricing errors, or verification issues.
- Refunds for cancelled orders shall be processed to the original payment method.
QUANTITY RESTRICTIONS
We may limit quantities purchased per user, household, or order. Unauthorized resale of Hectare products is prohibited and may result in account termination and legal action.
YOUR ACCOUNT
Users may create only one account. You are responsible for maintaining confidentiality of login credentials and for all activities conducted through your account. Accounts are non-transferable.
CUSTOMER COMMUNICATION
By using the Platforms, you consent to receive transactional and promotional communications via email, SMS, WhatsApp, phone calls, or other electronic means. You may opt out of promotional communications where applicable.
INTELLECTUAL PROPERTY RIGHTS
All content on the Platforms, including text, images, logos, designs, software, and trademarks, is owned or licensed by Hectare and protected under applicable intellectual property laws. No license is granted to use any intellectual property without prior written consent.
USAGE RESTRICTIONS
Users shall not:
- Upload or transmit unlawful, offensive, defamatory, or harmful content
- Infringe intellectual property rights
- Access unauthorized systems or data
- Disrupt Platform functionality
- Impersonate others
- Upload malware or harmful code
PLATFORM SECURITY
Any attempt to compromise Platform security may result in civil or criminal liability. Hectare reserves the right to investigate and cooperate with law enforcement.
INDEMNITY
You agree to indemnify and hold harmless Hectare, its directors, employees, and agents from any claims, losses, or damages arising from your breach of this User Agreement or violation of applicable laws.
LIMITATION OF LIABILITY
The Platforms are provided on an “as is” basis. To the maximum extent permitted by law, Hectare shall not be liable for indirect, incidental, consequential, or punitive damages. Our maximum liability shall not exceed the value of the product purchased or replacement thereof.
PRIVACY POLICY
Your use of the Platforms is governed by our Privacy Policy available on the Platforms. We are not responsible for the privacy practices of third-party websites.
TERMINATION
You may terminate this agreement by discontinuing use of the Platforms and requesting account closure. Hectare may terminate access at any time without notice. Obligations incurred prior to termination shall survive.
SEVERABILITY AND ENTIRE AGREEMENT
If any provision is held unenforceable, the remaining provisions shall remain valid. This User Agreement constitutes the entire agreement between you and Hectare.
GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by Indian law. Any disputes shall be subject to the exclusive jurisdiction of courts in Ahmedabad, Gujarat, and resolved through arbitration under the Arbitration and Conciliation Act, 1996.
